The agreement between you and William Hsia for using Wymatch. It applies to the website and to the iOS and Android apps.

The service
By using Wymatch you agree to these terms. If you do not agree, please do not use it. The service is provided by William Hsia, Piazza Vittorio Emanuele II, 12, 00185, Rome, Italy.
Wymatch helps padel and pickleball communities organise play. It provides groups, session scheduling and sign-ups, automatic match generation, score reporting, player ratings, leagues, tournaments, friend connections, and notifications.
Wymatch is an organising tool. We do not run sessions, provide coaching, book or operate venues, or supervise any activity arranged through the app. What you arrange with other players is between you and them.
Who can use it
You need to be at least 13. In the European Economic Area and the United Kingdom you need to be at least 16, or the lower minimum age your country sets. If you are under the age of majority where you live, a parent or guardian needs to accept these terms for you.

Your account
Give accurate information when you sign up. You can register with an email address and password, with Google, or on iOS with Apple.
You are responsible for:
Keeping your password and any linked sign-in method safe.
Everything that happens under your account.
Telling us promptly if someone else gets access to it.
Do not use another person's name, or a name you have no right to use. Do not keep several accounts in order to distort ratings or standings.

How to behave
When you use Wymatch, you agree to:
Describe yourself and your playing ability honestly.
Turn up for sessions you signed up to, or withdraw in good time.
Report results accurately.
Treat other people with respect, in the app and on court.
Leave ratings, standings, and results alone rather than gaming them.
Keep group invite links inside the group unless an administrator says otherwise.
Things you must not do
Break the law.
Pretend to be someone else.
Harass, abuse, threaten, or harm anyone.
Send spam.
Upload unlawful, offensive, or infringing content, including images.
Disrupt the service or the systems it runs on.
Try to reach any account, group, or part of the service you are not entitled to.
Work around security measures, including sign-in checks, permission checks, and rate limits.
Use scripts to harvest information or drive the app.
Reverse engineer the service, except where the law expressly allows it.

Groups and invites
Groups are private and people join by invite link. Each group has one permanent link, plus temporary links that expire.
Anyone with a working link can join, so links should be kept private.
An administrator can close the group to new members, switch the permanent link off, replace it, or delete temporary links. Replacing the permanent link stops the old link and any printed QR code working, immediately, for everyone.
Opening an invite link shows the group name, description, logo, and member count to whoever opened it, including people who are not signed in.
Groups have member limits that depend on their plan. The app shows the current limits.
Owners and administrators
Each group has one owner and can have administrators. They can:
Manage who is in the group, including removing people.
Create, edit, and cancel sessions, leagues, and tournaments.
Generate, edit, and publish matches, and record or reset results.
Adjust ratings, with every adjustment recorded in rating history.
Manage invite links and whether the group takes new members.
Owners and administrators are responsible for how their group runs and for handling members' information sensibly. Ownership can be passed to another member. We can remove an administrator, a group, or a user who breaks these terms.

Ratings and generated matches
Ratings are worked out automatically from reported results, and used to suggest balanced pairings. They exist to make recreational play easier to organise. They are not an official ranking, a qualification, or a measure recognised by any federation.
Ratings depend on results that other players report, which we do not verify, and administrators can adjust them. We do not promise that any rating or generated match is accurate, fair, or balanced.

Wymatch Pro and payments
How it works
Wymatch Pro is bought for a group, not for a person. Any member can add credit to the group wallet.
A wallet holds a prepaid balance in one currency. The currency comes from the group's timezone and is fixed once the wallet is first funded.
While a group is Pro, the monthly price comes out of that balance automatically. The app shows the price before you pay.
When the balance no longer covers another month, the group goes back to the free plan. It never goes into debt, and no card is charged automatically.
Stripe processes payments. We never receive your card details.
Credit belongs to the group
Credit you add goes to the group wallet, not to you. It pays for that group's Pro access and is used up over time. If you leave the group, are removed, or delete your account, whatever is left stays with the group and does not come back to you. Please think about that before funding a group you do not run.
Refunds
Unless the law says otherwise, wallet credit cannot be refunded once added, and money already taken for months of Pro access that have started is not refundable.
If you are a consumer in the EEA or the UK, you normally have 14 days to withdraw from a distance contract. Because credit lands in the wallet and Pro access can start straight away, you are asked to request that performance begins at once, and you accept that the right of withdrawal ends once the service has been fully performed. Where it has only partly been performed, you can withdraw and we will refund the unused part in proportion to what was supplied. Nothing in this section affects those statutory rights. Price and plan changes
We can change the price of Pro or what a plan includes. We will give notice before a change reaches a group, and no change applies backwards to credit already spent. Tax may apply depending on where you are, and is shown at checkout where relevant.

Your content
You can add content such as group names and descriptions, session and venue details, images, nicknames, and reported results. You are responsible for what you add, and you need the right to add it.
You keep every right in your content. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, and display it, purely so we can run and improve the service. That licence ends when you delete the content or your account, except where it forms part of a shared record other members still rely on, such as a match result.
We can remove content that breaks these terms or that we are legally required to take down.
Our content
The service and its own content, features, and design belong to William Hsia and its licensors, and are protected by copyright, trademark, and other laws. Please do not use our trademarks or trade dress without written permission.

Mobile apps
The apps come from the Apple App Store and Google Play, and those stores' terms apply as well as ours. We give you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control. The apps can receive over-the-air updates automatically, so fixes reach you without waiting for a store release.
For iOS
These terms are between you and William Hsia only, not Apple. Apple has no obligation to provide support or maintenance for the app. If the app fails to match any applicable warranty, you can tell Apple, and Apple will refund the purchase price if there was one. To the maximum extent the law allows, Apple has no other warranty obligation. Apple is not responsible for handling any claim about the app, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries can enforce these terms against you as third-party beneficiaries.

Ending your use
You can stop using Wymatch whenever you like, leave any group, or delete your account from the settings page. Deletion is immediate and cannot be undone. Our Privacy Policy sets out what gets deleted and what stays. If you own a group that has other members, pass ownership on first.
We can suspend or close your account if you break these terms, if the law requires it, or to protect other people or the service. Where it is reasonable and lawful, we will tell you why. Once your account ends, your right to use the service ends with it.
Availability
We can add, change, or remove features, and we sometimes take the service down for maintenance. We do not promise any particular level of availability. If we shut the service down for good, we will give reasonable notice so you can save anything you need, and refund unused group wallet balances where the law requires.

Risk and liability
Playing in person
Wymatch is used to arrange sport that happens in the real world. Padel, pickleball, and physical activity generally carry a risk of injury. You take part at your own risk, and it is up to you to judge whether you are fit to play and whether a venue and its equipment are safe.
We do not vet users, check identities or stated ability, supervise sessions, or inspect venues.
Disclaimer
So far as the law allows, the service is provided as it is and as available, with no warranties of any kind. We do not promise that it will be uninterrupted, secure, or free of errors, that defects will be fixed, or that ratings, matches, standings, or notifications will be accurate or arrive on time.
Limits
So far as the law allows, William Hsiaand its directors, employees, partners, agents, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, use, or goodwill, arising from your use of the service, from anyone else's conduct or content on it, from content you obtained through it, from unauthorised access to your content, or from injury or loss during activities arranged through it.
Where liability cannot lawfully be excluded, our total liability connected with the service is limited to the greater of what your group paid us in the twelve months before the claim, or the smallest amount the law allows.
Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. If you are a consumer, you keep every right your local consumer law gives you, and nothing in these terms overrides them.
Indemnity
You agree to cover William Hsia for any third-party claim, including reasonable legal costs, brought because of content you added, your use of the service, or your breach of these terms. This does not apply where the claim comes from our own breach or negligence, and it does not apply where you are a consumer and the law does not permit it.

Governing law and other terms
Governing law
These terms are governed by the law of Italy, and the courts of Italy have jurisdiction over any dispute.
If you are a consumer living in the European Economic Area or the United Kingdom, this does not take away the protection of the mandatory laws of your own country, and you can bring proceedings in your local courts. Consumers in the EU can also use the European Commission's online dispute resolution platform.
Severability
If any part of these terms turns out to be invalid or unenforceable, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about the service, and replace anything agreed earlier.
Changes
We can change these terms. If a change is significant we will give at least 30 days' notice in the app or by email before it takes effect. Carrying on using Wymatch after that means you accept the new version. If you do not, please stop using the service, and delete your account if you wish.
